PART 1: What Awaab’s Law Requires

Day 0 Trigger

Landlords must act the moment they become aware of a potential hazard, not when a formal complaint is made. Awareness may come from:

  • A tenant report
  • A contractor or housing officer
  • A sensor alert

This is Day 0, and the legal compliance clock starts immediately.

Hazard Categories

Hazards must be triaged into two legal categories:

  • Emergency: Poses imminent and significant risk of harm. Must be investigated and made safe within 24 hours.
  • Significant: Poses a serious health risk, but is not immediately life-threatening. Must be investigated within 10 working days and acted on within 5 working days of investigation conclusion.

Time-Bound Action

  • Emergency hazards must be made safe or the tenant rehoused within 24 hours.
  • Significant hazards must be investigated and resolved within 15 working days.
  • If repairs can’t begin in 5 days, they must start within 12 weeks, and the landlord must record and justify the delay.

Written Summaries

After every investigation, landlords must issue a clear written summary to the tenant within 3 working days. This must include:

  • Whether a hazard was found
  • Required actions
  • Estimated timelines
  • Contact information

Even when no hazard is found, the summary must still be provided.

Tenant-Centric Risk Assessment

Risk must be assessed relative to the tenant, not a generic standard. Landlords must consider:

  • Age (e.g., children, elderly)
  • Health conditions (e.g., COPD, asthma, pregnancy)
  • Time spent in the home

Even if a hazard scores low under HHSRS, it may still be legally significant under Awaab’s Law if the resident is vulnerable.

Audit Trail and Legal Defence

Landlords must prove they took “all reasonable steps” if a deadline is missed. This means:

  • Keeping full logs of communication and action
  • Documenting contractor delays or access issues
  • Showing escalation processes

Alternative Accommodation

If the home cannot be made safe in time, the landlord must:

• Offer suitable temporary housing
• Record tenant decisions
• Maintain full communication throughout the process
